Conditions of Sale

1. Premises
   

   The offer and sale of products on the website www.fercasa.eu

   constitute an offer to the public in accordance with the methods specified both in these General Conditions of Sale and on the Site. These General Conditions apply exclusively to purchases made on the Site by buyers who qualify as "consumers" pursuant to the Consumer Code.

   The Buyer is required to carefully read (i) these General Conditions of Sale, made available by La Fercasa sas, in pdf format, on the Site in order to allow their storage and reproduction, as well as (ii) all other information present on the Site, both before and during the purchase procedure.

   Individuals who do not fall into the category of "Consumers" are invited to contact La Fercasa sas. customer service at the following email address: info@fercasa.eu, to proceed with any purchases. The Company reserves the right not to process any purchase orders placed through the Site if the applicant is not a consumer.

   The products purchased on the site are sold directly by Fercasa sas, with registered office in Via Croce del Papa snc, 80035 Nola (NA), Naples Company Register Na-821545, CF and VAT number IT06536511212,
   

2. Definitions
   

   Buyer: means the consumer pursuant to art. 3 of the Consumer Code

   La Fercasa sas . or Company: indicates La Fercasa sas

   Consumer Code: indicates Legislative Decree 206/2005

   Privacy Code: indicates in their entirety the provisions of the European Regulation EU 2016/679, Legislative Decree 101/2018 and Legislative Decree 196/2003

   General Conditions of Sale: indicates the present contractual conditions that regulate the offer and sale on the Site, by La Fercasa sas., of products and services

   Decree on Electronic Commerce: indicates Legislative Decree 70/2003

   Parties: means, jointly, La Fercasa sas and the Buyer

3. Acquisitions
   

   The purchase of products on the Site is permitted only to those who are 18 years of age or older.

   To proceed with the purchase of products on the Site, the Buyer (even if not registered and, therefore, in "guest" mode) must follow the instructions indicated on the Site itself and in particular:

   • fill out the relevant "order form" in electronic format, entering:
     • the products purchased, identified on the Site, in the so-called "cart";
     • the Buyer's personal details (if in “guest” mode);
     • the place of delivery (also indicating the street number);
     • payment and shipping methods;
   • read the General Conditions of Sale, including, in particular, the conditions, terms and procedures for the possible exercise of the right of withdrawal, and the privacy policy reported on the Site;
   • send the “order form” to the Company.

   Registering on the Site allows the Buyer to manage purchases more easily and quickly and in particular:

   • check the status of your order and verify the history of your orders;
   • manage your delivery addresses;
   • manage information relating to your personal profile;
   • change your newsletter subscription status for commercial communications purposes;
   • modify and integrate the chosen payment methods.

   The "order form," displayed before submission (and therefore prior to the conclusion of the contract), provides a summary of the essential characteristics of each product ordered, a detailed price (including all applicable taxes or duties), the chosen payment method and any related costs, the chosen delivery method and any related costs, the shipping address, and the estimated delivery time. The information provided in the "order form" constitutes an integral and substantial part of these General Conditions of Sale and, therefore, is deemed to be fully understood and accepted by the Buyer upon submission of the "order form."

   By submitting the "order form" you agree to read and accept the General Conditions of Sale and, more generally, the information contained in the "order form" itself, as well as the privacy policy.

   The purchase and, consequently, the underlying contract is concluded upon receipt of the "order form" by the Company which, as proof of the purchase, proceeds to send the Buyer, to the email address provided by the same, an "order confirmation" (with indication of the "order number") summarizing the products purchased, the related prices, the chosen payment method and any related costs, the chosen delivery method and any related costs, the shipping location and the estimated delivery time.

   Changing an order cannot be done independently; the Buyer wishing to change the order must contact customer service immediately—and in any case no later than 60 minutes after submitting the order form—and scrupulously follow the instructions provided by the aforementioned customer service.

   The Company reserves the right not to process purchase orders that do not provide sufficient guarantees of solvency, are incomplete, or are incorrect, or if the products are unavailable. In these cases, La Fercasa sas will promptly inform the Buyer—and in any case within 72 hours of receiving the order form—that the Company has not fulfilled the purchase order, specifying the reasons. In such cases, the contract will be deemed terminated between the parties, and, if payment has already been made, the Company will refund the amount paid.
   
   

4. Payments
   

   Payment is made when the “order form” is sent to the Company.

   To pay for the products and related shipping and delivery costs, the Buyer must indicate one of the multiple payment methods offered on the "order form." This choice will also be highlighted in the "order confirmation."

   The information provided for this purpose (for example, your credit/debit card number or expiration date) will be forwarded, where applicable, via encrypted protocol, to the bank that provides the Company with remote electronic payment services, without third parties having any access to it. Furthermore, this information will never be used by the Company except to (i) complete the purchase procedures; (ii) issue any related refunds; (iii) prevent or report fraud on the Site to the police.

   If the Buyer chooses to pay by bank transfer, shipping and delivery will only take place after the price of the products has been credited to the current account in the name of La Fercasa sas.
   
   

5. Shipping and Delivery of Products
   

   The Company offers free shipping and delivery within the Italian Republic using specialized carriers specifically selected and appointed by La Fercasa sas.

   Customers wishing to receive Products in territories not included in the above list are invited to contact La Fercasa sas customer service at the following email address: info@fercasa.eu. The Company reserves the right not to process any purchase orders placed by Buyers wishing to receive Products in territories not included in the above list.

   The Buyer is required to indicate in the "order form", among the options offered, the preferred method and the shipping and delivery information for the products. This choice will also be highlighted in the "order confirmation". Delivery of the ordered goods is intended to be at street level (any delivery methods other than "street level" must be requested in the order form and will be subject to evaluation by the Company, with adjustment of shipping costs).

   The information provided for this purpose (including, for example, the delivery address) will be used solely for the purpose of fulfilling the contract.

   Upon delivery, the Buyer or a trusted person must be present to check that the packaging is intact and clean and that the products received correspond to the order. In the event of visible defects, such as incorrect quantities and/or incorrect products, or damaged packaging, La Fercasa sas requires the Buyer (or their trusted representative) to report such anomalies on the shipping document and to contact La Fercasa sas Customer Service immediately.

   Without prejudice to the estimated delivery time based on the chosen shipping method (reported both in the "order form" and in the "order confirmation"), the products purchased on the Site will, in any case, be delivered within 30 (thirty) days of the conclusion of the contract.

   For shipments outside the territory of the Italian Republic, any additional customs clearance costs will be borne by the Buyer, as the Company cannot know the aforementioned additional costs and predict their amount.

   Customs policies vary considerably between countries, so the Buyer is responsible for contacting their local customs office for further information.

   Any Buyer who places orders on the Site and requests delivery to a country other than Italy is considered the "importer": consequently, the Buyer is required to comply with the current legislation and regulations of the country in which he will receive the ordered products.

   Before placing an order on the Site, the Buyer is required to ensure that the importation of the item he wishes to order is not prohibited by the laws in force in the destination country.

   Customs offices in some destination countries outside Europe may require the recipient to provide a specific identification number for the package in order to ship. The Buyer, as the importer of the package, and the recipient, if applicable, may be required to provide this identification number, the "name" of which may vary depending on the destination country.

   
   
6. Right of withdrawal and refund
   

   The Buyer has the right to withdraw from the contract concluded with La Fercasa sas without any penalty and without specifying the reason, within fourteen (14) days from the day of receipt (by the Buyer or his/her trusted representative) of the products purchased on the Site.

   To withdraw from the contract, the buyer can:

   • use the withdrawal form (available on the Site), to be filled in and sent directly online through the Site itself (in this case the Company will send the Buyer confirmation to the email address provided by the latter of the receipt of the withdrawal request) or
   • draw up and send to the Company another explicit declaration of the decision to withdraw from the contract (in this case, the burden of proving the correct and timely exercise of the right of withdrawal will fall on the Buyer).

   Once the right to withdraw from the contract has been exercised, the Buyer must return the previously purchased products to the Company - at his own expense - by handing them over to the courier for shipment within fourteen (14) days from the moment in which the Buyer communicated to the Company the decision to withdraw from the contract. The deadline is met if the Buyer ships the purchased products before the 14-day period expires.

   The Buyer is responsible

   • The decrease in value of the products resulting from handling other than what is strictly necessary to establish their nature, characteristics, and functioning. The products may be inspected but must not be used or damaged in any way. They must therefore be stored with normal diligence and returned intact, perfectly suitable for their intended use, free from any signs of wear or dirt, complete in all their parts, with the original packaging and original protective covers as received, complete with all accessories and information leaflets, with any identification tags, labels, and disposable seals, if present, still attached to the products, intact, and untampered with. The products sold on the Site are original and are shipped in their original packaging. When returning products, they must be returned as received, in their original packaging, complete with the original protective covers that guarantee their integrity, and including any accessories and/or elements that are an integral part of the product (e.g., identification tag with disposable seal).
   • for the loss or damage of returned products during transport.

   If the right of withdrawal is exercised in compliance with the aforementioned conditions, La Fercasa sas - once the products have been received and the checks have been carried out (within the terms indicated above), with positive results - will refund any sums already received for the purchase of the products.

   In the event that the products for which the right of withdrawal has been exercised have suffered a decrease in value resulting from handling other than that necessary to establish their nature, characteristics, and functioning, the refund amount will be reduced by an amount equal to such decrease in value. La Fercasa sas will notify the Buyer of this circumstance and the resulting reduced refund amount via email within 7 (seven) business days of receiving the products, subsequently proceeding with a partial refund or, if the refund has already been paid in full, providing the Buyer with the bank details for payment of the amount owed by the Buyer to La Fercasa sas due to the decrease in value of the returned products. As an alternative to a partial refund, the Buyer has the option of (re)obtaining the products in the condition in which they were returned to La Fercasa sas. In this case, the right of withdrawal is considered not to have been exercised and the products will remain at La Fercasa sas at the Buyer's disposal for collection, which must take place at the Buyer's expense and under his/her responsibility.

   If the right of withdrawal is not exercised in accordance with applicable law and, in particular, in addition to failure to comply with the aforementioned terms, if the products are not intact in all respects and/or accompanied by their accessories and/or elements that are an integral part of them (e.g., identification tag, disposable seal, original packaging, original protective covers, etc.) or, in any case, are used, such withdrawal will not result in termination of the contract and, consequently, will not entitle the Buyer to a refund of the amount paid for the Product. La Fercasa sas will notify the Buyer of this decision via email within 7 (seven) business days of receiving the products, rejecting the withdrawal request. The Products, if already received by Fercasa sas, will remain at the Buyer's disposal for collection, which must take place at the Buyer's expense and under his/her own responsibility within fifteen days of receiving the notification rejecting the withdrawal.

   Fercasa sas will refund the amount using the same payment method used by the Buyer to purchase the returned products, unless otherwise agreed between the Parties. If the recipient of the products indicated on the order form is not the same as the person who made the payment for the products, the refund, in the event the right of withdrawal is exercised, will in any case be made to the person who made the payment.

   
   
7. Warranty
   

   The Buyer has the right to avail of the legal guarantee provided by the Consumer Code in articles 128-135, valid for 2 years from the date of delivery, for so-called defects of conformity.

   This guarantee requires, among other things, that the Buyer, under penalty of forfeiture, report to La Fercasa sas. any defect of conformity found in the purchased product within 2 (two) months of discovery.

   There is a lack of conformity when the purchased product:

   • it is not suitable for the use for which goods of the same type are normally used;
   • does not conform to the description given by Fercasa sas. and does not possess the qualities of the good that the Company presented to the Buyer as a sample or model;
   • it is not suitable for the particular use intended by the Buyer and which was brought to the attention of Fercasa sas by the latter at the time of conclusion of the contract and which the Company accepted.

   Therefore, any damage or malfunctions caused by accidental events or by the Buyer's responsibility (for example, uses that do not comply with the instructions given by Fercasa sas in the documentation accompanying the products or improper uses) or by use of the product that does not comply with its intended use and/or with what is provided in the technical documentation, where present, attached to the product or in any case in the public domain, are excluded from the scope of application of the guarantee.

   Some of the products on the Site and offered for sale are handcrafted products, that is, products that may show, depending on the specific artisanal/manual processes to which they are subjected (by way of example and not limited to (i) the hand-painting and/or finishing of the product, (ii) the coloring of the solid wood), some "imperfections"; these "imperfections" do not constitute a defect in the products but a peculiarity of the artisanal process that distinguishes them from other mass-produced products.

   Some of the products on the Site and offered for sale are self-assembly products and are accompanied by assembly instructions, which the Buyer is required to follow scrupulously. Therefore, any damage caused by the Buyer to the products during assembly cannot be considered defects of conformity.

   In any case, La Fercasa sas. will never be required to install the products listed on the Site and offered for sale.

   Following any complaint, once the existence of the defect of conformity has been verified, the Buyer will have the right to request the repair or replacement of the product, without prejudice to the other rights provided for by the Consumer Code.

9. Privacy
   

   The Buyer's data is processed by La Fercasa sas

10. In accordance with the provisions of the legislation on personal data protection, as specified in the information provided on the website in the section www.fercasa.eu/privacy, also taking into account the provisions of Articles 8 and 9 of the E-Commerce Decree.
    

11. Applicable law
    

    The General Conditions of Sale are governed by Italian law and, in particular, by the Consumer Code and the Decree on Electronic Commerce.
    
    

12. Edit and update
    

    The General Conditions of Sale may also be modified to reflect any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on the Site. In any case, the General Conditions of Sale published on the Site at the time the order form is submitted will apply to individual purchases.
